Publisher assumes no responsibilities for any errors that may appear in the software or documentation. Expert Lease is a registered trademark of Chart Software, Inc. Copy Protection ---------------------------------------------------------------------- The Expert Lease software is not copy-protected. This does not mean that you can make unlimited copies of the software or documentation. The Expert Lease software is protected by the copyright laws that pertain to computer software. It is illegal to make copies of the contents of this disk, except for backup purposes, without written permission from the Publisher. Specifically, it is illegal to give a copy to another person. Return Policy ---------------------------------------------------------------------- Due to the nature of the product and license agreements with various data suppliers, there are no refunds for software. Notice of Subscriber (User) Obligation Regarding Data ---------------------------------------------------------------------- National Auto Research Division, Hearst Business Media Corp is the exclusive owner of the New Car Invoice Database and Black Book® Residual Databases (hereinafter the "Databases") and any derivative works thereof, within the Expert Lease® Pro software program, deemed the sole property of National Auto Research Division. Subscriber (User) further agrees National Auto Research Division shall retain exclusive ownership of Databases including all literary property rights, copyrights, trademarks, trade secrets, tradenames or servicemarks, including goodwill and any derivative works thereof. Subscriber acknowledges that the Databases are confidential, proprietary material, therefore, Subscriber agrees to protect the confidentiality and proprietary nature of such Databases and shall not disassemble, de-compile, reproduce, create derivative works, market, distribute, sell, utilize or otherwise make available to third parties the Databases, in any form, in whole or in part, except for those Subscribers (i.e. business concerns) that utilize the information solely for commercial use; shall be permitted to obtain a printed copy of the information on a vehicle per vehicle look-up basis for such utilization. National Auto Research Division, Hearst Business Media Corporation makes no warranty and assumes no responsibility for accuracy, errors or omissions of the Databases or any derivative work thereof. National Auto Research Division expressly disclaims any warranties express or implied with respect to the Expert Lease® Pro software program and shall have no liability whatsoever with respect thereto. The terms and conditions of this Notice of Obligation shall be construed and enforced in accordance with the law of the State of New York and any disputes hereunder shall be determined in the courts of the State of New York. This Notice of Obligation is deemed valid upon Subscriber's acceptance of the Expert Lease® Pro software program. Data ---------------------------------------------------------------------- All data included with Expert Lease or Expert Lease Pro - including but not limited to pricing data, residual value data, and rebate information - is copyrighted by the respective publishers and is licensed for use with this program. This license prohibits the re-sale, rental, and/or distribution of this data. Data may be used as a reference together with Expert Lease Pro as a tool to provide consulting services to others. If you fail to abide by the above terms, this license and agreement are automatically terminated. Such termination shall be in addition to and not in lieu of any criminal, civil, or other remedies available to Publisher.
